Certainly. One of the first things we do when meeting with a client is to assess whether their estate will actually require probate. This involves two key considerations: the value of the estate and the presence of non-probate assets.

In California, estates valued at $184,500 or less are generally exempt from probate. Consequently, if an individual’s assets fall below this threshold, they may be able to avoid the probate process altogether.

Moreover, certain assets are considered “non-probate” and pass directly to designated beneficiaries outside of probate. These include assets held in trust, jointly owned property with rights of survivorship, and payable-on-death accounts.

It’s essential to identify all non-probate assets as they can significantly reduce the value of an estate subject to probate. For instance, a client might have a home owned jointly with their spouse. Upon the passing of one spouse, ownership automatically transfers to the surviving spouse, bypassing probate entirely.

Nevertheless, even if an estate is valued above the threshold, careful planning can minimize the probate process and associated costs. Properly structured trusts, for example, can help transfer assets outside of probate.
