Reporter: Brenda Davis
Good afternoon, Mr. Bliss, thank you for taking the time to speak with me today.
Steve Bliss: My pleasure, Brenda. It’s always important to spread awareness about estate planning.
Brenda: Absolutely! Today I want to talk about one of the key steps in the estate planning process: Selecting an Executor or Trustee. Can you elaborate on why this step is so crucial?
Steve Bliss: Certainly, Brenda. Choosing an executor for your will or a trustee for your trust is arguably one of the most important decisions you’ll make during the estate planning process. This individual, or entity, will be responsible for carrying out your wishes after you’re gone. They will manage your assets, pay debts and taxes, and ultimately distribute your property according to your instructions.
Consequently, it’s vital to select someone trustworthy, responsible, and capable of handling these complex tasks. Ideally, this person should have good organizational skills, financial literacy, and the ability to make sound decisions under pressure. They should also be comfortable communicating with beneficiaries and navigating any potential conflicts that may arise.
Moreover, it’s important to consider factors such as age and health when choosing an executor or trustee. You want someone who is likely to be around when the time comes to settle your estate. You can also name successor executors or trustees in case your primary choice is unable to serve.
I recall one instance where a client named their eldest child as executor, but unfortunately, they had a falling out with that child shortly before passing. This led to significant family strife and legal complications during the probate process. It highlights the importance of carefully considering all potential candidates and communicating openly with your loved ones about your choice.
Studies by the American Bar Association indicate that over 50% of adults in the United States do not have a will or trust in place. This means their assets may be distributed according to state law, which may not align with their wishes. Choosing an executor or trustee is a crucial step in ensuring your estate is handled according to your preferences.
Brenda: Thank you for sharing that insight, Mr. Bliss. What advice would you give to someone who’s unsure about who to choose?
Steve Bliss: It’s understandable to feel overwhelmed by this decision. I often advise my clients to make a list of potential candidates and consider their strengths and weaknesses. Talk openly with your family about your wishes and see if there’s consensus on who would be the best fit.
If you’re still unsure, consulting with an experienced estate planning attorney can be incredibly helpful. We can guide you through the process, explain your options, and help you make an informed decision that will protect your legacy for years to come.
