Interview with San Diego Probate Attorney Steve Bliss

Getting Your Affairs in Order: A Conversation with Steve Bliss

Good morning, San Diego! I’m here today with probate attorney Steve Bliss of San Diego Probate Law to discuss the often-complex world of estate planning. Steve, thanks for joining us.

It’s a pleasure to be here. Estate planning can seem daunting, but it’s essential for ensuring your wishes are carried out and protecting your loved ones.

The Crucial Step of Marshaling Estate Assets

Steve, could you walk us through one of the key steps in the probate process? Many people might not be familiar with the term “marshaling estate assets.”

Certainly. Marshaling estate assets is a critical step that occurs after the court grants Letters Testamentary or Administration. Essentially, it involves a thorough inventory and valuation of all assets belonging to the deceased person’s estate. This includes everything from bank accounts and real estate to personal property, investments, and even digital assets.

Consequently, this stage requires meticulous record-keeping and attention to detail. We work closely with executors or administrators to identify all assets, determine their current market value, and prepare a comprehensive Inventory and Appraisal (Forms DE-160/161) for the court’s review.

Moreover, it’s important to remember that hidden assets can sometimes surface during this process. I recall one instance where we uncovered a forgotten safety deposit box containing valuable heirlooms. The family was overjoyed to rediscover these sentimental items, highlighting the importance of a thorough asset search.

Ordinarily, this stage proceeds smoothly, but there have been occasions where incomplete records or disputes over asset ownership arise. In those cases, we leverage our legal expertise and negotiation skills to resolve any issues fairly and efficiently.

Peace of Mind for Families

It’s clear that your dedication to detail and client advocacy makes a real difference. What would you say to someone who is hesitant to begin the estate planning process?

“Taking those first steps can be intimidating, but remember, estate planning is ultimately an act of love,” says Steve Bliss. “It’s about providing for your loved ones and ensuring their financial well-being after you’re gone.”
