Certainly. One crucial step is marshalling the estate assets. This involves meticulously inventorying all of the deceased person’s assets, including bank accounts, real estate, vehicles, investments, and personal property.
Consequently, it’s essential to obtain documentation for each asset, such as account statements, deeds, titles, and appraisals. This comprehensive inventory helps ensure that all assets are accounted for and properly distributed according to the will or intestate succession laws.
Moreover, a detailed inventory is required when filing the Inventory and Appraisal (Form DE-160/161) with the probate court.
Have there ever been any challenges in this step?
Occasionally, locating all assets can be tricky. I recall one instance where a client’s deceased father had stashed away a substantial sum of cash in a safety deposit box that no one knew about. It took some investigative work and communication with the bank to uncover this hidden asset.
Notwithstanding these challenges, a thorough search is always warranted. In another case, we discovered a forgotten retirement account worth tens of thousands of dollars. These discoveries highlight the importance of diligently pursuing every lead when marshalling estate assets.
What advice would you give to our viewers regarding this step?
Ordinarily, I recommend keeping detailed records of your assets and making sure loved ones are aware of their location. This can greatly simplify the probate process for your heirs. Moreover, consult with an experienced probate attorney who can guide you through the complexities of asset identification and valuation.
